TERMS OF SERVICE

 Effective October 3, 2019

 

The following terms and conditions (“Terms”) apply to your clinical appointments at 1721 Main Medical Clinic Inc. dba YYoung Medical Clinic (“YYoung”).  Please read these Terms carefully. They contain very important information about your rights and obligations, as well as limitations and exclusions that may apply to you.

This website (“Website”) is a platform in which you may book appointments for services and or products provided by our health care practitioners (“Services”). The Website also provides the community with health awareness education.

These Terms must be read with this Website’s general Terms of Use of Website.

These Terms are subject to modification by YYoung without prior written notice at any time, at YYoung’s sole discretion.

 

BOOKING AN APPOINTMENT

You may book an appointment online or by email. Walk-in appointments are subject to availability.

 

INSURANCE COVERAGE

If you have a valid MSP card and MSP coverage, your visit is free of charge, unless you are seeking an uninsured service (please see below). 

 

INTERNATIONAL VISITORS, TOURISTS, AND INTERNATIONAL STUDENTS

YYoung provides medical services to international visitors, tourists, and international students.  Please contact YYoung regarding the fees associated with your appointment.  YYoung will provide you with a receipt so that you can seek reimbursement from your insurance, depending on your coverage.

 

NON-INSURED SERVICES

You acknowledge that there are some services that the Medical Services Plan (MSP) does not cover. You are responsible for paying in full the fee for using those Services at the end of your appointment. It is your responsibility to confirm the fee associated with the Service before booking the appointment.  Our medical practitioners are not required to advise if the Service is non-insurable or the fee associated with the Service.  Please telephone and consult our medical office assistant for specific fee requests, if they are not already stated on the Website.

 

CANCELLATION OF APPOINTMENT

To cancel an appointment, please email us with at least 24 hours’ notice prior to your appointment to cancel.

 

DISCLAIMER

The Website is a platform that allows customers to book appointments to access Services provided by our medical practitioners.  You understand that we make no representations or warranties as to the quality, condition, fitness, or suitability of the Services.  Neither YYoung, its parent, subsidiaries, affiliates, or any of their respective employees, agents, officers, directors (“Company Parties”), contractors, or medical practitioners, make any warranty, condition, quality, fitness, or suitability of any kind, whether express or implied, regarding the Services provided or advertised on the Website and YYoung specifically disclaims the implied warranties and conditions of merchantable quality, fitness for a particular purpose, to the maximum extent permitted by law.

 

LIMITATION OF LIABILITY

Company Parties will not be liable for any loss suffered by you, including but not limited to personal injury, indirect, consequential, special or punitive damages, even if advised of the possibility of such damages, or any loss resulting from a claim by any third party.  Without limiting the generality of the foregoing, the Company Parties are not liable to you for any loss suffered by you as a result of the Services provided by the clinical practitioners and service providers of the YYoung clinic.  In any case, if Company Parties are held liable to you for whatever reason, Company Parties are not liable or responsible for any amount of damages beyond $5000.00 CAD.

 

ENTIRE AGREEMENT

These Terms together with the Terms of Use of Website, and all other notices, policies, and statements contained on this Website (all as may be amended by YYoung from time to time without prior notice) constitute the entire agreement between you and YYoung.  These Terms may not be altered, supplemented, or amended by the use of any other documents. Any attempt to alter, supplement or amend this document will be null and void. These Terms may be changed by YYoung at any time, in its sole discretion without prior notice, with respect to any future sales or transactions with you.

 

PRIVACY

You have read YYoung’s Privacy and Data Handling Policy, the terms of which appear on this Website and are incorporated into these Terms. You agree that the terms of this policy are reasonable. You consent to the collection, use and disclosure of your personal information by YYoung or its agents or representatives in accordance with the terms of and for the purposes set forth in the Privacy Policy.

 

GOVERNING LAW

These Terms will be governed by and construed in accordance with laws of the Province of British Columbia and of Canada, and any disputes relating to these terms and conditions will be subject to the exclusive jurisdiction of the courts of the Province of British Columbia, Canada.

 

GENERAL

The failure of YYoung to assert a right hereunder or to insist upon compliance with any term or condition will not constitute a waiver of that right or excuse any subsequent non-performance of any such term or condition by you. The headings used in these Terms are included for convenience only and will not limit or otherwise affect these Terms. If any provision of these Terms will be ruled unenforceable, then the remainder will be enforced to the extent permissible. This Website is not intended for use by children under the age of 19. Use of this Website is void where prohibited by applicable law.

We use software from Healthism Systems Inc. dba Inputhealth Systems to allow you to, amongst other things, book appointments online and fill and submit forms online. If a customer does not consent to providing YYoung with the requested information necessary to do business, YYoung employee will provide the reasons to the customer and advise him or her of the pending consequences if the information is not supplied.  In some cases, this may result in YYoung ceasing delivery of the Services to the customer. If YYoung requires original information to be used for a different purpose than previously provided, customers will be advised in advance and consent obtained prior to the new use.

YYoung expects customers to provide accurate information and notify YYoung of any changes to continue with effective administration or service. Such things as (but not limited to) phone numbers and addresses must be kept up to date by the customer periodically.

 

Security & Safeguard

YYoung has implemented technology and security features and policy guidelines to safeguard the privacy of your customer identifiable information from unauthorized access or improper use. All information collected from customers is safeguarded through various means such as (but not limited to): restricted access to databases and servers, cyphering, passwords, encryption, as well as locked filing cabinets and storages for information collected in paper form. All staff are trained in proper safeguarding of information with periodic audits conducted.  If paper documents containing personal customer information are no longer required, they are shredded.

Unfortunately, no data transmission over the Internet can be guaranteed to be 100% secure. As a result, while this Website strives to protect your personal information, we cannot warrant the security of any information you transmit to us, and you do so at your own risk. Once this Website receives your transmission, we make commercially reasonable efforts to ensure its security on our systems.

 

Access

This policy is communicated to all its customers and employees. Customers have access to this policy through YYoung’s website. Employees are regularly trained to ensure the protection and privacy of customer information.  At any time a customer may contact the company to view all personal information collected by the company and ascertain how it is being used or disclosed. There may be times in which some information will be restricted if there are references to other identifiable individuals, legal concerns, security or propriety rights or costs.  If this is the case, the individual making the request will be advised of the reasons for the restrictions on disclosure.

 YYoung respects your personal information.  YYoung will comply with provincial and federal legislation regarding the protection of your personal information, including but not limited to Personal Information Protection Act (BC), Personal Information Protection and Electronic Documents Act (Canada), and Breach of Security Safeguards Regulations (Canada).

If there are any breaches of security safeguards involving your personal information under our control, which poses a significant harm to you, then we shall follow the reporting requirements in Personal Information Protection and Electronic Documents Act (Canada), and Breach of Security Safeguards Regulations (Canada).

If you miss an appointment, this takes away from another patient who needs to see a physician/practitioner. 

We have a 24 hour cancellation policy for telephone, virtual, and in person visits. There is a non-refundable late cancellation/missed appointment fee of $50, which must be settled before you are able to re-book another appointment.
